Terms of Service

I am willing to discuss a different contract with the commissioner. Commercial/additional rights to an image will increase the price range of the commission.I reserve the right to refuse to take your commission at any point before payment. I will accept payment only after accepting your commission. If you send money to my paypal before I accept your commission and I refuse to take your commission, I may not refund your money. Please wait until after we have agreed upon the commission and discussed the contract before payment.


What I Won't Draw

-ABDL ("Diaper" content)-Suicide-Sexual Assault / Abuse
-Non-consent-Underage Characters-Loli / Shota

This is not an exhaustive list–I reserve the right to refuse a commission for any reason.*I won't accept commissions involving copyrighted characters or IPs (unless I have permission) as I would be profiting off of another entity's property. I still draw copyrighted characters in personal fanart, but this is strictly not a source of profit.


Payment

I take payment only through Paypal. For anything $100 or less, I take payment up front; for anything higher, I take half of the payment up front. Once the commission is agreed on, I will advise you on how to send money to me. Do not send money until you have received instructions from me! I won’t start working until the first payment is received.


Image Rights

By default, I retain copyright to the image, which means I can post it online to my social media sites and use it in my portfolio. The commissioner is free to distribute, print, post and utilize the image for personal use (credit to the artist is appreciated), but not for commercial use or profit. The commissioner may not claim the art as their own. If the commissioner chooses not to claim the original physical work (if there is one), I retain the right to re-sell it. The commissioner may re-sell their painting, but for no more than the original price it was commissioned for (basically, for no profit). The commissioner retains the copyright to any of their intellectual property/character designs used in the image.


Cancellation

If the commission is canceled while in progress, I will offer a partial refund (according to how much has been completed) as well as what work has been completed up to that point. I reserve the right to cancel a commission if the commissioner is abusive, or doesn’t respond to my communication within 30 days (without good reason). I will not refund finished pieces.


Process

Thumbnails, sketches, and process images will be provided throughout the process for full illustrations. After the initial drawing phase, the process images are only sent upon request. Revisions are okay, of course, but concerns should be addressed at an early stage and not in excess, or there will be an extra charge for the time required to make these changes.(I will occasionally stream commissions online)All communication will be done via e-mail or approved logged chat service.

Frequently Asked Questions

Q: Are commissions open?

A: I accept work by inquiry. I am accepting commission inquiries by e-mail (to kiit0sart[at]gmail[dot]com) and through google forms but I cannot guarantee they will be accepted quickly or at all. I keep all inquiries and address them in the order they are received.


Q: What’s the best method of contact?

A: While I try to read my notes and messages on social media / art sites, the most reliable way to send an inquiry is by e-mail to kiit0sart[at]gmail[dot]com.If you do contact me via other methods, please understand that I may not respond in a timely manner, if at all.


Q: What should go into a commission inquiry?

A: Give me as much information as you can, as though you were making an art request. Please provide art references of your character, as I charge more if there aren't references. The more details I have, the faster I can give you a pricing estimate and let you know what I am / am not okay with. I will let you know if I cannot take your commission, I don't aim to leave people waiting in the dark if I can help it.


Q: What kind of stuff can one get from a commission?

A: I generally offer anything from a shaded sketch to a rendered pinup with simple BG, and anything from a headshot to full-body (check out the pricing section). I am also working towards offering commissions of game-ready (VRChat-ready) 3D models. I am willing to discuss other projects or things outside of my usual skill set but please understand there may be additional costs and questionable quality/consistency.


Q: What won’t you draw?

A: Please refer to my terms of service section “What I won’t draw”.


Q: How much will it cost?

A: I conduct pricing on a project-by-project basis. I have a pricing section which includes a pricing calculator you can use to get a ballpark estimate of what your idea will cost, but to get an exact quote you'll have to send me an inquiry.


Q: What is the turnaround on a commission?

A: There are two parts to the commission process to consider for determining turnaround (how quickly you’ll get art from me):

  1. For the inquiry, once you e-mail me or submit a form (your initial inquiry and details of the request) I’ll aim to reply to you within 5 business days with my feedback and a pricing estimate. From there, if I’m not currently accepting any work, I’ll ask you to wait until I am ready to take stuff. I will not accept money from you until I am ready to accept new work. The inquiry and feedback process is not a guarantee that I will accept your commission request.

  2. Once I have accepted your commission, we will agree on a price and I will invoice you for the commission. Once the minimum amount is paid (see my TOS for details), I will begin working right away, and I intend to finish your piece within a few weeks at most, unless there are complications. If I don’t think I can meet my desired time-frame, I will reach out to you with this information and we will agree on a new time-frame or partial refund on a case-by-case basis.


Q: Something’s wrong, or doesn’t line up with the information here, what next?

A: I track all open inquiries to my e-mail on a private trello board. It’s unlikely that I’ve forgotten about you or your attempt to contact me. Sometimes, however, mistakes happen and I’m very sorry if your inquiry was missed, or I somehow forgot about your commission or missed my time-frames for turnaround. When something like this happens, please communicate with me over e-mail or our established method of contact. I am certain we can work out a compromise that satisfies all parties. If I forgot about you and you don’t communicate back to me, I may not realize my error until way later and then nobody is happy :C
